Naman Howell Attorneys File Amicus Brief in Supreme Court Election-Law Case

News

11.25.25 | Naman Howell Member Attorneys Phillip M. Gordon and Mark Altman, along with Associate Attorney Abbi White Harris, have filed an amicus curiae brief with the United States Supreme Court on behalf of the Center for Election Confidence in Public Interest Legal Foundation v. Benson (No. 25-437). Their work demonstrates the firm’s long-standing commitment to defending democratic freedoms and holding election administration processes to high standards of transparency and accountability.

The National Significance

The case raises a fundamental question: What does it mean for states to maintain accurate voter rolls and provide meaningful public access to election records?

While the National Voter Registration Act requires states to make a “reasonable effort” to keep voter lists current, courts have disagreed on how effective those efforts must be, and who has standing to ensure compliance. The Supreme Court’s decision on the current matter could shape election-administration standards nationwide for years to come.

The Client Issue

The Center for Election Confidence (CEC), a non-partisan, non-profit organization, promotes ethics, integrity, and professionalism in the electoral process. It works to ensure that all citizens can vote freely within an election system that maintains reasonable procedures, prevents vote dilution and disenfranchisement, and instills public confidence in election outcomes. To advance these goals, CEC conducts, funds, and publishes research analyzing the effectiveness of current and proposed election methods. CEC serves as a resource for lawyers, journalists, policymakers, courts, and others interested in the electoral process. CEC also engages in public-interest litigation to uphold the rule of law and election integrity and files amicus briefs in cases where its expertise and national perspective can illuminate the issues under consideration.

On behalf of CEC’s interests, Naman Howell Public Policy & Constitutional Law attorneys believe this case addresses important questions regarding the National Voter Registration Act (NVRA), including whether the NVRA's "reasonable effort" requirement demands that state voter roll maintenance programs be effective in removing 25,000 ineligible voters and whether citizens and organizations have standing to enforce the NVRA's public disclosure requirements.

Our attorney’s brief argues that Congress intended the NVRA to require demonstrable effectiveness, not just procedural compliance, and that public disclosure provisions are essential to citizen oversight of election administration. It is the right of every American citizen and organization to oversee election practices and ensure ethical accountability of our elected officials.

The Community Impact

The American legislature and legal system are founded on the belief that a citizen’s voice and vote matter. Accurate voter registration rolls, transparent election processes, and diligent citizen oversight are foundational to a trustworthy democracy that upholds this belief. This filing reflects Naman Howell’s commitment to protecting democratic principles and election integrity. We are proud that our Public Policy & Constitutional Law attorneys defend their clients’ rights, whether it be in local state courts or the U.S. Supreme Court, and any Appellate Court in between.
