Kerr & O'Dell Successful in the Fifth Circuit
Naman Howell attorneys Kaitlin Kerr and Shane O’Dell successfully defended an appeal challenging several district court rulings in favor of our client before the United States Court of Appeals for the Fifth Circuit. Leading up to the appeal, Attorneys Kerr and O’Dell secured an order granting a Motion for Summary Judgment in the United States District Court for the Southern District of Texas, which resulted in the dismissal of all claims brought against our client.
The Plaintiff then appealed to the Fifth Circuit, challenging the district court’s rulings in favor of our client on three separate motions in an attempt to overturn our client’s dismissal from the case. Following extensive briefing and oral argument before Circuit Judges Elrod, Willett, and Duncan, the Fifth Circuit issued an opinion adopting the arguments raised by Attorneys Kerr and O’Dell in their briefing, affirming the district court’s rulings, and upholding the dismissal of our client from the case.
