PILOT WINS PRE-TRIAL DISMISSAL OF POTENTIAL $1 MILLION SLIP-AND-FALL CLAIM
Naman Howell Premises Liability – Defense focused on lack of evidence to win pre-trial summary judgment for Pilot Travel Centers LLC.
Member David Ortega and Associate Amado Montoya focused on the lack of evidence to win early dismissal of Olivia vs. Pilot Travel Centers before the United States District Court for the Western District of Texas Midland/Odessa Division.
Plaintiff claimed he slipped and fell inside a Pilot Travel Center in Odessa, Texas, allegedly because of a liquid substance on the floor. He sought up to $1 million in damages, including claims for present and future injuries.
While the plaintiff focused on damages, the defense followed the facts and lack of liability evidence. The result was a complete defense victory. The federal court granted Pilot’s motion for summary judgment and ordered that the plaintiff’s claims be dismissed with prejudice.
