Our Texas IP Attorneys Can Protect Your Rights

Intellectual Property Litigation

Naman, Howell is actively engaged in a wide range of intellectual property legal work, including a growing patent infringement and patent litigation practice. While Naman, Howell was founded in Waco, Texas in 1917, the firm currently represents clients in IP litigation matters throughout the Western District of Texas, including the Waco, Austin, and San Antonio Divisions (Offices in Waco, Austin, San Antonio). We are currently serving as local counsel in a variety of patent litigation matters for lead counsel located outside of Texas. While we have handled intellectual property litigation matters on a first-chair basis in the Western District of Texas in the past and will continue to do so, we have recently seen a sharp increase in our local counsel work related to patent infringement cases filed in the Western District of Texas since Judge Alan Albright became our Judge in the Waco Division.

Our lawyers live and practice in Waco, Austin, and San Antonio and have deep roots in their local communities. For instance, lawyers in the Waco Office who would staff IP litigation matters have clerked in the Western District of Texas, Waco Division, served in the past on the Court’s local rules committee and ADA committee, and are currently involved in local legal and civic organizations in Waco such as the Judge Abner V. McCall Inn of Court, Waco-McLennan County Bar Association, and Waco Rotary Club. Unlike many other law firms that may have satellite offices in or near Waco, Austin, or San Antonio, if you hire Naman, Howell to assist on your legal matter, your case will be handled by attorneys who actually live and practice law in Waco, Austin, or San Antonio and are familiar with the local courts and their personnel. This is important given the recent influx of patent litigation cases in places like the Western District of Texas, Waco Division.

In addition to IP litigation matters, our law firm also handles prosecution of patent applications, trademark applications, licensing matters, non-disclosure agreements, and many other intellectual property and transactional matters.

Intellectual Property Prosecution

Our legal system has laws in place to protect intellectual property just as it does for physical property such as homes, land, and personal items. Intellectual property typically refers to created works, such as a work of literature or art, which may or may not be tangible items. The Texas intellectual property lawyers at Naman, Howell, Smith and Lee, PLLC represents clients in a wide variety of intellectual property cases. As with traditional property, there are several types of intellectual property that are protected under these federal laws.

There are three key components of intellectual property law:

  • Patent
  • Trademark
  • Copyright

Patents, Trademarks & Copyrights

Companies or individuals who invent a specific product should acquire a patent to protect their rights. A patent grants rights to protect the product from replication for a limited period of time. Most companies already have a trademark in place. A trademark is a word, phrase, design, or symbol that clearly identifies a company or individual from others in the same industry. Infringing on another person or company's trademark sullies the brands of both companies and laws are strictly enforced.

Copyright is one of the most common terms used to describe something of which individuals or companies want to claim ownership. The coverage of copyright items is broad and includes many works such as paintings, photos, books, and poems. As long as an individual or company rightfully created the content, it remains theirs. This type of law protects that work, particularly the right to or not to reproduce it.
